Een huwelijk in Vietnam met een Vietnamese onderdaan valt onder de Vietnamese wetgeving; ter informatie volgt hieronder de van het Vietnamese Ministerie van Buitenlandse Zaken ontvangen regelgeving terzake.

Guidance for marriages involving foreign elements
(Under Decree no. 68/2002/ND-CP dated 10 July 2002 of the Government)
I. For foreign citizens:
- Marriage registration declaration form (issued by the VN Ministry of Justice) with confirmation of single status (not older than 6 months till the date of application). This confirmation can be made on the form, or as a separate certificate. If the competent authority of that foreign country does not issue such kind of certificate, a certified statement by the applicant should be submitted in lieu.
- Health certificate issued by a competent authority of Vietnam (i.e. Center for Mental Health) or that foreign country which is not older than 6 months till the date of application), confirming that the applicant is not suffering from mental diseases; or if she/he has some mental problems, she/he must still be able to know her/his act.
- A copy of passport; or a copy of residential permit for expatriates
- A filled resume (set form)
II. For Vietnamese citizens:
- Marriage registration form (issued by the VN Ministry of Justice) with certification of single status, which is issued by the applicant’s commune/ward People’s Committee.
- Health certificate issued by a competent authority of Vietnam (i.e. Center for Mental Health) or that foreign country which is not older than 6 months till the date of application), confirming that the applicant is not suffering from mental diseases; or if she/he has some mental problems, she/he must still be able to know her/his act.
- A copy of her/his ID card, Residential registration book or temporary residential registration certificate (once residential registration book is not yet issued)
- A filled resume (set form)
Apart from these papers, applicants must submit the following:
For divorced persons: a copy of the court’s judgment on his/her divorce; or divorce decision which is legally effective.
For persons whose spouses died or were stated dead: a copy of the death certificate
The application must be made into two sets and submitted at the city or provincial Department of Justice by both applicants. In case one applicant can not show up, the other must submit also an authorized paper.
Papers in foreign languages must be submitted in originals, with certified Vietnamese versions made at one of the public Notary Offices.
Papers issued by Diplomatic Missions in Vietnam must be legalized by the Vietnamese Ministry of Foreign Affairs or by the Ministry’s authorized offices (i.e. Foreign Affairs Department).
Papers issued by the competent authorities in a foreign country must be legalized by the Ministry of Foreign Affairs in that country and by the Vietnamese Embassy/Consulate in that country.
Duration for settlement is 30 days (including weekend & public holidays).
Recentelijk is er een aanvulling uitgegeven (Decree No. 69/2006/ND-CP) op bovenvermelde regelgeving;
de essentie van deze aanvulling luidt als volgt:
In an effort to minimize cases where the involved parties register for marriage (through brokerage) without understanding about each other as well as each other’s language, the new decree stipulates that provincial/municipal Justice Services have to interview the involved parties to check their voluntariness to marry, their ability to communicate in a commun language and their understanding about each other’s conditions.
In principle, face-to-face interviews will be conducted for all marriages between Vietnamese citizens and foreigners and be recorded in written documents which must include the opinions and signatures of the interviewers.
